Abstract: In this talk, Fischel offers a strong take against sex exceptionalism in criminal law: it is, he suggests, catastrophically stupid.

Fischel makes the case in two parts: through a feminist-but-also-queer critique of rape law and a queer-but-also-feminist examination of sodomy laws in Lousiana.

Ultimately, Fischel argues for a right to queerness--a right to relatively unpoliced sexual and gender freedom--and asks how we might champion, or at least protect, such a right in this fascist moment.
